Trump's Regime of Consequences and Incentives

Trump's intense desire for retribution has swiftly morphed into a structured system. Over the year since his election, the president's rage and whims have assumed the guise of administrative measures in ways comparable to past dictatorial regimes. Government officials who resist his demands are summarily dismissed and substituted by loyalists. Opposing figures who question him face legal action, trial and sanctions. Opponents have been designated under presidential memoranda as “unpatriotic”, “against faith communities” and “against free markets”, and warned with criminal charges as “terrorists”.

The Justice System Transformed

All case involving legal action of political opponents and protection for loyalists exhibits its own distinct qualities. Yet, notwithstanding their individual character, they exemplify examples of what has arisen as a deliberate technique. Those incidents are far from isolated. His purge of DoJ prosecutors and law enforcement agents, coupled with his placement of loyalists in senior roles, started swiftly, quickly took on a pattern, and has now been shaped into a regime. The justice department and the law enforcement agency have been restructured into political organizations under Trump's direct orders to carry out his directives. Unfairness has been turned into standard. It constitutes the apparatus of revenge.

Leadership is more concerned with targeting the leader's perceived opponents than they are with safeguarding our country's safety.

Inside the System

The origin of this system has been exposed in the lawsuit of three former senior law enforcement agents filed in September in the federal court in DC against FBI director a senior appointee and attorney general another official for unlawful firing in “a effort of retribution against Plaintiffs for what administration figures considered to be a refusal to demonstrate proper devotion”. In the complaint that one official, the previous interim leader, describes a discussion in which he “openly acknowledged the impropriety of his actions”.

Driscoll had attempted to shield FBI agents from being terminated, the filing states. The director informed him that “White House figures” – perceived by him to be the executive branch and DoJ – had ordered him to remove all those who they considered as having participated in a criminal investigation against the president. The complaint continues: “He explained that he had to fire the individuals his superiors told him to dismiss, because his ability to hold his own position was contingent on the removal of the personnel who were involved in cases involving the leader. The director commented that there was no option he or him could do to stop these or any other firings, because ‘the bureau attempted to incarcerate the President in jail and he hasn't forgotten it.’” After Driscoll told him he was violating the agency's own internal rules, Patel supposedly said “he knew that and he realized the nature of the summary firings were almost certainly unlawful”.

Extensive Consequences

After his reported admission to Driscoll, the DoJ and the FBI have been weakened and repurposed for Trump's system of punishment. Multiple of the agency's top officials were terminated or forced out in the early weeks of the presidency. About numerous legal professionals at the justice department have taken a “voluntary departure plan”. At least several government attorneys, among them those in the southern district of New York, stepped down in dissent over what they considered as ideological pressure in dropping the criminal prosecution against the local official, a political figure, in return for his cooperation with Trump's federal agency arrests of immigrants. The public integrity section of the justice department, which manages misconduct investigations, has been cut down to two attorneys. The civil rights division has been severely reduced: seventy percent of its staff has departed. 33% of senior leaders at DoJ have left. The section upholding conservation statutes has seen departures of a majority its management.

Incentives and Sanctions

Concerning the legal matter, the interim prosecutor for the NY office, the official, quit in objection against what she described as the “trade-off”. The border official, his “immigration leader,” showed up as the enforcer with Adams on a media outlet to declare: “If he doesn't come through, I will return in NYC.”. Additionally, Emil Bove, previously the acting deputy attorney general and a past legal representative, who brokered the arrangement, was awarded an judicial position, a possible springboard to the judicial branch.

The president's immunity for offenses perpetrated while in power, provided by the extraordinary judgment of the Republican majority on the supreme court, thus blocking his legal action over the political violence and preserving his public standing for the 2024 election, is the cornerstone on which he stands to defend his loyalists. With such immunity, he has been freed to permit misconduct. The consequence of the supreme court decision permeates his government and the political party down to its bones. Trump v United States has metastasized. In the words of Richard Nixon's administration lawyer John Dean said about the Watergate
